Ohio Court of Appeals rules against El Tropical
In an October 20, 2009 decision, the Court of Appeals of Ohio’s Tenth Appellate District ruled for the City of Cleveland and against El Tropical (W. 44th and Storer Ave) in the nightclub’s effort to renew its liquor permit. The Court of Appeals ruling affirmed the Franklin County Court of Common Pleas decision in which affirmed earlier rulings by the Ohio Liquor Control Commission and the Superintendent of the Division of Liquor Control to deny El Tropical’s application to renew its 2007 - 2008 liquor permit.
According to court documents, the case officially began on July 11, 1997 when the City of Cleveland objected to El Tropical’s application to renew its liquor license “claiming that the bar was responsible for fights, gunshots, violence, noise, drug usage, thefts and other disturbances on the premises and in the area; the bar was a strain on the police force, and neighbors in the area had voiced numerous complaints about the business.”
El Tropical has 45 days in which to file an appeal to the Ohio Supreme Court or face closure.
